General Terms and Conditions for
Consulting Seminars and
Trainings held by BK Business KONSENS OG

General Terms and Conditions of BK-Business KONSENS OG (hereinafter also referred to as “Business KONSENS” and “Contractor”) concerning the provision of services for clients (hereinafter also referred to as “Client:in”) in the areas of consulting, training, seminars, coaching and outdoor activities in nature, as of May 2023.

1. general
By registering or placing an order for a Business KONSENS event, the General Terms and Conditions are deemed to be accepted. This also applies to subsequent business, unless expressly agreed otherwise. Verbal changes and additions are only effective if they have been confirmed in writing by Business KONSENS, the contractor.
Registrations are made in the order of their arrival. Registrations, rebookings or cancellations will only be accepted in writing (mail, fax or e-mail).
Each registration is binding.
Invoices are payable without deduction upon presentation.
In case of late payment, interest on arrears will be charged at the usual bank rate. The client is not entitled to withhold payments or to offset them against his own claims.
In order for a confirmation of attendance to be issued, at least 90% attendance is required.
Clients and business partners agree that the data of their organization, which is collected in the course of the seminar registration, will be included in the company database of Business KONSENS, IsyKonsens International OG, acceptify GmbH. Please note that e-mail addresses of our customers and business partners will be used to inform you about news, event dates, offers, information etc. of Business KONSENS. If this is not desired, this can be stopped at any time by sending a written message to volker.visotschnig@businesskonsens.eu.
Participation in events of Business KONSENS is at your own risk and responsibility. No liability can be assumed for personal (valuable) objects of the participants.
The instructions of the trainers/consultants must be followed, especially during outdoor events and bodywork. The contractor is only liable for damages in case of gross negligence and intent. In any case, liability for consequential damages and financial losses, in particular due to delay, impossibility of performance, loss of profit, expected but not realized savings – as far as legally permissible – is excluded.
Changes in the event program: Business KONSENS assumes no liability for printing and typographical errors in publications and on the website. Furthermore, Business KONSENS reserves the right to make organizational changes to the program and to cancel events.
The realization of events depends on the minimum number of participants.
In case of disputes between the contracting parties arising from the present business case, the competent court in Graz shall have exclusive jurisdiction.
Austrian law is exclusively applicable. The UN Convention on Contracts for the International Sale of Goods shall not apply.
Should individual conditions be void or legally ineffective, this does not affect the legal validity of the remaining conditions.
All trainers/consultants have a contractual relationship with Business KONSENS. The client is not entitled to induce them to accept orders on their own account.
All products and services delivered by Business KONSENS are protected by copyright. It is not allowed to copy, duplicate, pass them on to third parties or publish them in any other media without written permission.

2. public events
2.1 Seminar costs
All prices quoted are exclusive of VAT and accommodation costs. The payment before
seminar is a prerequisite for participation. Your registration becomes binding for both parties with the sending of a written confirmation.
2.2 Room reservation
For all seminars lasting several days, room reservations are the responsibility of the client. The costs of the stay (overnight stay, full board, seminar flat rates) are to be settled directly with the hotel unless otherwise stated in the price/booking modalities.

2.3 Cancellation conditions
2.3.1 Cancellations by the Client
In view of the necessary long-term seminar preparations and the associated time commitment of our trainers/consultants, we ask you to observe our cancellation conditions. From 6 weeks prior to the start of the seminar, we charge 50% of the seminar fee in the event of cancellation or rebooking; from 4 weeks prior to the start of the seminar, the full seminar fee is due. If a substitute participant is registered, the cancellation fee is waived. Cancellations must be made in writing without exception. In the case of cooperation seminars, the cancellation conditions of the respective institute/hotel apply.

2.3.2 Cancellations by the contractor “Business KONSENS
Cancellations by the contractor will be communicated to the participants at least 2 weeks before the start of the seminar or, in the case of outdoor events, at short notice (1 day before). Exceptions are cancellations due to illness of trainers/consultants and circumstances that Business KONSENS cannot influence. The organizer guarantees the possibility of a free rebooking to another date, 100% credit or refund of the seminar costs. The contractor cannot be held liable for the non-occurrence of an event and any resulting consequential costs.

3. company internal events
3.1 Costs
All prices quoted are exclusive of value added tax. In principle, expenses such as official mileage allowance (from the trainer’s/consultant’s place of residence to the event location), accommodation and catering costs for the trainer/consultant will be charged according to expenditure, unless it is explicitly included in the offer.
